1. Acceptance of Terms

By downloading, installing, or using the POH Buddy mobile application ("App") or this website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or this website.

These Terms constitute a legally binding agreement between you and the developer of POH Buddy ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after any such changes constitutes your acceptance of the new Terms.

2. Nature of the Application

POH Buddy is a convenience reference tool that presents selected performance data from Pilot's Operating Handbooks ("POH") for informational purposes only. The App is intended to supplement — not replace — official aviation documentation and proper preflight planning procedures.

Safety Notice: The pilot-in-command is ultimately and solely responsible for ensuring the safe operation of any aircraft. You must always verify any performance figures obtained through this App against the official, current POH or Aircraft Flight Manual (AFM) for your specific aircraft before relying on such data for flight operations. Never substitute this App for proper flight planning, thorough preflight checks, or sound aeronautical decision-making.

3. Accuracy and Completeness of Data

While we strive to present accurate data, we make no representations or warranties — express or implied — regarding the accuracy, completeness, reliability, or suitability of the performance data contained in the App. Aircraft performance data may vary based on aircraft serial number, modification status, environmental conditions, equipment variations, and other factors not captured in generalized POH tables.

You acknowledge that:

Actual aircraft performance may differ from figures shown in the App.
POH and AFM documents may be revised by the manufacturer; the App may not reflect the most current revision.
The App does not account for aircraft-specific factors such as airframe wear, paint condition, or unapproved modifications.
No data from this App should be used as the sole basis for any flight planning or in-flight decision.

4. Service Provided "As Is"

The App and all associated services are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free from defects. We shall not be liable for any damages arising from your use of, or inability to use, the App.

5. Updates and Modifications

We are continuously working to improve POH Buddy and intend to release updates that may add new aircraft, correct data, or improve functionality. However, we reserve the right to:

Modify, suspend, or discontinue any part of the App at any time, with or without notice.
Change, update, or remove aircraft performance data, features, or supported aircraft models at our sole discretion.
Alter these Terms of Use at any time; the most current version will always be published on this page.

We are under no obligation to provide updates, new features, or continued support for any version of the App.

6. Subscription and Payment

POH Buddy may offer a free trial period and optional paid subscription tiers. The following terms apply:

Subscriptions are billed through the Apple App Store or Google Play Store under their respective terms and conditions.
We reserve the right to modify the pricing, subscription model, or the features included in any tier at any time. Changes to the payment model will be communicated through the App or this website.
Refund requests are subject to the policies of the relevant app store platform.
A free trial, if offered, is intended for genuine evaluation of the App. Only one free trial per user is permitted.

Trial Period Integrity: Any user found to be circumventing, manipulating, or abusing the free trial period — by any means including but not limited to creating multiple accounts, resetting device identifiers, or exploiting platform mechanisms — may have their access to the App suspended or permanently denied without notice or refund.

7. Intellectual Property

All content, design, code, and data within POH Buddy and this website are the property of their respective owners. POH performance data is derived from publicly available aircraft documentation. You may not copy, redistribute, reproduce, or create derivative works from the App's content without express written permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of life, personal injury, property damage, or loss of data — arising from your use or misuse of this App. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

You expressly acknowledge that aviation activities carry inherent risk, and you assume full responsibility for all decisions made in connection with aircraft operation.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the developer's jurisdiction of residence.
